Legislation

The Chauffeured Transportation Association of New Jersey maintains a watchful eye in Trenton, safeguarding chauffeured transportation companies from being blindsided by legislation that would make operating in the Garden State unnecessarily difficult or expensive.

In our efforts to ensure that operators and suppliers doing business in New Jersey are treated fairly by legislators, enforcement officers and governing bodies, the association has been successful in resolving long-standing issues, including:

• Repealing the sales and use tax on the purchase, lease, rental and repair parts of limousines. 
  
• The removal of this tax has saved chauffeured transportation operators thousands of dollars, enabling them to turn over and maintain their fleets more aggressively. In addition to clients enjoying newer and better-maintained vehicles as a result of this bill getting signed into law, the entire industry benefits from having raised standards of safety and service.
• Spearheading the passing of New Jersey’s “Limo Law” expressly designed to improve safety in the state.
  
• The law addresses important issues, such as maximum vehicle passenger capacities and insurance minimums.
  
• Ensuring the chauffeured transportation is exempt from the workers compensation category that includes taxis, UPS and FedEx and, instead, has its own category.
  
• CTANJ also secured legislation that protects operators from having to pay workers compensation on gratuities — a major savings to operators.

U.S. Department of Transportation

• DOT serves the United States by ensuring a fast, safe, efficient, accessible and convenient transportation system that meets vital national interests and enhances the quality of life of the American people, today and into the future.
  

Transportation Network Company Safety and Regulatory Act

• The Act establishes statewide standards for TNCs, including requirements regarding driver eligibility, insurance coverage and records retention. The uniformity inherent in the legislation stabilizes the market for TNCs in New Jersey, effectively dispelling discrepancies in standards across different municipalities.
  

Limo Law

• Highlights for this landmark bill include:
• Benefitting the industry by bringing Avis WeDriveU under the same regulations as chauffeured transportation, eliminating local/municipality fees on chauffeured service and increasing the number of passengers legally allowed in a stretch limousine
• Stepping up enforcement of criminal background checks for all chauffeurs, requiring licensed drivers to have an endorsement on their licenses indicating a valid criminal background check
• Forbidding TLC-licensed for-hire drivers from using cell phones, either manual or hands-free, while driving a for-hire vehicles

New Jersey Window Tint Law

• Darkness of tint: Darkness of tint is measured by Visible Light Transmission percentage (VLT%). Here’s a guide comparing the VLT percentages. In New Jersey, this percentage refers to percentage of visible light allowed in through the combination of film and the window.
• Windshield – No tint is allowed on the windshield.
• Front Side Windows – No tint can be applied legally to this window.
• Back Side Windows – Any darkness can be used.
• Rear Window – Any darkness can be used.
• Reflectiveness of tint:
• Front Side Windows – No metallic or mirrored appearance.
• Back Side Windows – No metallic or mirrored appearance.
• Other rules and regulations:
• Restricted Colors – No colors of tint are explicitly banned.
• Side Mirrors – Dual side mirrors are required if back window is tinted.
• Certificate Requirements -Manufactures of film do NOT need to certify the film they sell in the state.
• Sticker Requirements – No sticker to identify legal tinting is required.
• Medical Exemption – State allows medical exemptions for special tint.

• It is the responsibility of motor carrier operators and drivers to know and comply with all applicable requirements and regulations. Regulatory compliance and safe operations translate into saved lives and property. New Jersey Paid Family Leave

• New Jersey law provides up to six weeks (42 days) of Family Leave Insurance benefits.

Information on the New Jersey Sales and Use Tax Act

• The New Jersey Sales and Use Tax Act was recently amended to include an exemption for the sale of limousine, to a person licensed by the New Jersey Division of Motor Vehicles.
• Effective May 1, 2017, limousine transportation services are not subject to New Jersey Sales and Use Tax.
